Tracey is a Partner in the Litigation Department. 

Tracey has broad experience in commercial disputes including injunctive and other urgent relief.  She appears in the High Court (including the Commercial List), Court of Appeal, and Supreme Court and in mediations and arbitrations.  She has also appeared in the Court of Appeal of Samoa, the Cook Islands High Court and as junior counsel in the Privy Council.

Tracey's specialist areas are the enforcement of intellectual property rights and all aspects of communications, advertising and media law with a focus on defamation, contempt, suppression, privacy, Broadcasting Standards and advertising compliance issues.  Tracey has spent more than 10 years acting for the broadcast media and for claimants in defamation claims. 

She has also acted in complex commercial fraud cases, contractual disputes, minority shareholder claims, insider trading claims, international arbitration, insurance contract disputes and has advised clients in numerous disputes with the Crown in connection with mineral and fisheries resources.

• Acting for TVNZ (High Court, Court of Appeal and Supreme Court) in injunction proceedings by a murder accused to restrain broadcast of a videotaped confession, winning the appeal in the Supreme Court

• Acting for a US party in a multiparty international arbitration arising out of a financing transaction

• Acting for a major accounting firm in a High Court defamation claim

• Acting for an international brand owner challenging a competitor's use of colour on its get-up

• Acting for a FMCG producer in connection with a competitor's misleading and deceptive product get-up and claims

• Acting for a manufacturer in connection with labelling and advertising compliance issues

• Lead counsel in the Supreme Court trade mark case for Austin Nichols (Wild Turkey bourbon)

• Acting for a clothing manufacturer (Russell Athletic) against counterfeit product sellers

• Advising the public issuer in an insider trading proceeding brought by the Securities Commission against former directors and executives

• Acting for Virgin Group in trade mark enforcement proceedings

• Acting for Novartis in patent infringement litigation with Astra Zeneca
