Commercial Litigation Competition and Regulatory Law
Anne is a senior litigation partner at Simpson Grierson.
Anne specialises in competition law and in that capacity, she provides opinion and compliance advice, regularly assists clients who are being investigated by the Commerce Commission and has conducted numerous cases under the Commerce Act and Fair Trading Act.
In the regulatory area Anne has worked closely with electricity sector and telecommunications clients in a range of High Court cases and hearings before the Commerce Commission.
Anne heads the firm's litigation department and is on the Board of Simpson Grierson.
While many claims and Commerce Commission investigations on which Anne has worked have been resolved commercially without legal proceedings being brought, listed below are some examples of matters which have gone to court:
- Competition law claims by the Commerce Commission or private claimants in relation to: vitamins; wood preservatives and airlines.
- Anne was counsel in the leading New Zealand case on price fixing penalties (Commerce Commission v Koppers Arch, High Court, 2006) and the follow up civil claims case and counsel in the leading case on jurisdictional challenges to Commerce Commission prosecution of overseas companies in New Zealand (Bomac v F Hoffman La Roche, High Court, 2002). She was also counsel in the vitamins litigation where the Commerce Commission's claim was successfully struck out (Commerce Commission v Roche, High Court, 2003).
- Injunction proceedings to prevent liquidation of joint venture (Vero Insurance New Zealand Limited v Fleet Insurance & Risk Management Limited, High Court, 2007).
Fair Trading Act prosecution on credit card charges (Commerce Commission v Westpac, 2006).
- Prosecution under the Credit Contracts & Consumer Finance Act (Commerce Commission v Senate Finance Limited, 2006).
- Defence of injunction and judicial review proceedings brought in relation to client's governing council (Forbes v Coxhead, High Court, 2005).
- Representing electricity sector clients in a precedent setting series of cases involving competition law claims and enforcement of standard commercial contracts (eg Transpower v Meridian Energy, High Court, 2001).
- Commerce Commission hearings involving the authorisation of self governance rules for the electricity sector and, in the telecommunications area, concerning access to broadband services.
