James Craig is a Senior Associate in the firm’s Litigation Department.  He specialises in competition law and commercial litigation.

James provides advice on all aspects of restrictive trade practices under the Commerce Act and routinely provides advice on Fair Trading Act issues and disputes.  He has represented clients in investigations by the Commerce Commission, and been involved in significant High Court litigation dealing with Commerce Act and Fair Trading Act claims.  James also regularly provides compliance seminars to clients on the Commerce and Fair Trading Acts.

James' energy experience includes extensive work in the electricity sector where he has worked with State Owned Enterprises and also with large commercial users of electricity.


  • Leading case on penalties for breach of section 30 of the Commerce Act (Commerce Commission v KANZ and Others)
  • Two cases concerning the powers of the Commerce Commission under section 98 of the Commerce Act (KANZ v Commerce Commission)
  • Obtaining an exemption from the cross involvement provisions of the Electricity Industry Reform Act (Commerce Commission Decision 536)
  • Successfully defending a $9 million challenge to the Council's tendering process (Onyx Group Limited v Auckland City Council)
  • High Court proceedings involving price fixing claims by the Commerce Commission and private litigants, including successfully striking out the Commission's claim (Commerce Commission v Roche Products (NZ) and Others; Bomac Laboratories v F. Hoffman-La Roche Ltd and Ors)
  • High Court litigation on the enforcement of standard network contracts (Transpower NZ v Meridian Energy; Transpower NZ v Cobb Power)
  • High Court litigation involving Commerce Act and judicial review claims against a State Owned Enterprise (Vector v Transpower NZ)
