Media and Broadcasting Commercial Litigation
Jania is a Senior Associate practising in the firm's litigation department. She has broad experience in all aspects of commercial and civil litigation and dispute resolution, including expertise in media law issues and claims.
Jania has acted on a wide range of major commercial cases involving director's duties, insolvency, minority shareholder claims, breach of contract, tort, fraud, professional indemnity, Fair Trading Act and intellectual property.
In addition, Jania has specialist expertise in media law, broadcasting and advertising. She has acted for both TVNZ and other people and organisations in major defamation cases. She regularly advises TVNZ on media law issues involving defamation, contempt, televising the Courts, suppression, Broadcasting Standards, and provides pre publication advice.
She spent several years practising in London with the leading insurance based litigation practice Barlow, Lyde & Gilbert.
Jania appears before all levels of the New Zealand Courts. She is also experienced in mediation and is a member of LEADR. Jania aims to provide pragmatic commercial advice to resolve disputes in an innovative and cost effective manner.
- Acts for TVNZ in both providing pre publication advice and in defending a number of defamation and other media related claims
- Acted for Koppers Arch Wood Protection (NZ) in defending a claim for breach of contract and fiduciary duties in the sum of $2.6 million
- Acted for WH Smith in a claim against BSG (US Office Products) for breaches of warranties arising out of WH Smith's purchase of the Whitcoulls and Angus & Robertson chains of bookstores ($5 million escrow fund)
- Acted for Eagle Technology Group Limited in respect of a claim for $18 million concerning alleged breaches of directors' duties, statutory duties and shareholder oppression. Resolved by mediation
