Welcome to the November edition of Simpson Grierson's x-tech ezine.

One of the great areas of debate when negotiating an IT contract is the area of indemnities. Both parties commonly drive to be indemnified for everything they can think of, while retreating from the prospect of giving an indemnity with fear and a faint smell of panic. The question is, is this great preoccupation with indemnities really justified? These issues are considered by Karen Ngan and Adam Jackson in their article Is that indemnity really worth fighting for?

Next, convergence between broadcasting, telecommunications and the Internet due to rapidly evolving digital technology is significantly changing New Zealand's broadcasting environment. The Government has recognised this and, following consideration of public submissions on consultation and discussion papers published on content regulation and regulation for digital broadcasting, has now proposed an extensive work programme to tackle the issues identified. In our second article, Karen Ngan and Kiri David look at some of the key areas of focus for the work programme and proposed next steps.

The Copyright (New Technologies) Amendment Act was passed on 8 April 2008 and will come into force shortly. One of the main areas of discussion has focussed on ISPs - who they are, what are their obligations and what is the scope of their potential liability under the Act. In our third article Richard Watts and Sonya Hill comment on the potentially uncertain position of ISPs.
