Prior to the addition of specific computer crime provisions into the Crimes Act in October 2003, perpetrators of crimes involving the access and use of computers could only be convicted under traditional fraud, forgery and wilful damage offences. Increasing recognition of the inadequacy of these offences to deal with the growing sophisticated nature of computer crimes led to the computer specific offences being introduced. A recent case illustrates how once again the amended Crimes Act has been used effectively and the court has delivered its most substantial punishment yet.
