The Ministry of Economic Development (MED) has released a discussion paper which considers certain aspects of New Zealand's copyright regime under the Copyright Act 1994 (Act). The MED is seeking input on two key issues which affect the IT industry:

  • circumstances where it is appropriate to contract out of copyright legislation; and
  • the adequacy of the so called "commissioning rule" which deals with first ownership of copyright in respect of certain commissioned works (including software).
