John Shackleton

John leads the commercial litigation team in the firm's Wellington office and is a member of the firm's board of management. He is a commercial litigation and dispute resolution specialist with over 25 years' experience.

John acts for large corporate and local authority clients on major commercial and public law litigation, appearing in the courts at all levels. He also regularly assists clients to resolve disputes through arbitration, mediation, and negotiated settlements. 

John has specialist expertise in complex contractual cases, tortious claims including professional negligence, and advises on strategy and risk for regulatory compliance. He is also experienced in securities enforcement litigation, including receiverships and liquidations, commercial property disputes, and the energy sector.

  • Wellington City Council - litigation with Meridian Energy seeking judicial review of the Council's rating treatment of wind energy facilities
  • Chatham Rock Phosphate - defending a claim by the Environmental Protection Agency for costs in connection with Chatham Rock Phosphate's application for a marine consent under the Exclusive Economic Zone Act
  • Kaipara District Council - a claim in negligence in connection with Council audits carried out by the Auditor-General during the planning, construction, and funding of a multi-million dollar wastewater plant in Mangawhai
  • Christchurch City Council - multi-party litigation before a full bench of the High Court concerning the interpretation and application of the Earthquake Commission Act 1993 to land and buildings at increased risk of flooding following the Canterbury earthquakes of 2010 and 2011
  • Christchurch City Council - defending multiple claims for judicial review of the Council's decision to install a new $844 million pressure wastewater system as part of the new horizontal infrastructure for the city following the Canterbury earthquakes
  • Grey District Council - acting for the Council in proceedings in the High Court, Court of Appeal and Supreme Court in defending a challenge to the validity of the Council's ground leases 
  • New Plymouth District Council - defending over 150 claims in the High Court, and subsequently on appeal to Court of Appeal and Supreme Court from lessees seeking to freehold land held on ground leases
  • OMV - litigation involving a joint venture dispute concerning the Maui pipeline
  • Wellington City Council - defending weathertightness claims 
  • Acting for receivers and liquidators in various disputes, particularly in the finance industry and agricultural sector
