Kathryn McLean

Kathryn is a senior associate in the firm's local government and environment group in Wellington. She is a public lawyer, with experience in advising both local and central government clients.

Kathryn advises on a wide range of local government matters, including decision-making, consultation, governance, council-controlled organisations, conflicts of interest, bylaws, and rating and valuation disputes. She is also skilled in advising on the handling of requests for official information and personal information.

Kathryn has experience with the legislative process, having worked with government departments to develop and progress legislation, and helped other organisations to engage effectively with departments and select committees.

Examples of Work

  • Advised the local authorities driving the establishment of the New Zealand Local Government Funding Agency Ltd (LGFA), including promoting legislative changes that led to the Local Government Borrowing Act 2011 and advising on decision-making and consultation requirements for local authorities wanting to become shareholders or participate in the LGFA
  • Local Government Commission - advised the Commission on various legal issues to do with the proposed reorganisation scheme for the Nelson and Tasman districts
  • Christchurch City Council - assisted on a range of emergency management issues following the Canterbury earthquakes, including promoting several Orders in Council under the Canterbury Earthquake Response and Recovery Act 2010
  • Waikato Regional Council - advised on the Council's decision-making process concerning its decision to contribute funding the National Cycling Centre of Excellence
  • Local Government New Zealand - advised on the effect of a key 2011 High Court case, Nelson Gambling Taskforce Incorporated v Nelson City Council, on local government decision-making and consultation
  • Christchurch City Council - advised on conflict of interest matters concerning the appointment of the chief executive, which became the subject of the 2011 High Court case Howe v Keown
  • Auckland City Council - assisted with its submission to the Royal Commission on Auckland Governance, and drafted its submission to the select committee on the Local Government (Auckland Council) Bill and the Local Government (Auckland Law Reform) Bill
  • Kāpiti Coast District Council - presented workshops for all staff members on privacy, focusing on compliance with the information privacy principles
  • Secondments as a legal adviser at the New Zealand Transport Agency, the Department of Internal Affairs, the Department of Building and Housing, and the Ministry of Research, Science and Technology
