Tim is experienced in all aspects of resource management law, including subdivision, land-use and property development, infrastructure projects, plan-making, and designations. He acts for local authorities, corporates, and developers.

Tim also has experience with public law matters and the wider legislative framework affecting the local government sector through the work he has done with local authorities. This work has traversed a wide range of legal matters, from information issues through to alcohol policy and regulation.

Successfully defending Environment Court and High Court appeals against the Council’s decision to retain an Outstanding Natural Feature and land containing elite soils outside the Rural Urban Boundary under the Auckland Unitary Plan.

Waikato Regional Council 

Conducting appeals before the Environment Court in relation to Plan Change 1, one of the largest plan changes of its kind, seeking to reduce the amount of contaminants entering into the Waikato and Waipā catchments.

Tauranga City Council 

Advice and representation in relation to plan changes relating to flood hazard management and earthworks, including Environment Court appeals.

Successfully defending judicial review proceedings challenging the Council’s decision to grant consent for a mixed-use development without public notification.

Conducting Environment Court proceedings to determine the landscape status of Matakana Island in the Western Bay of Plenty, a proposed plan change affecting significant forestry holdings on Matakana Island and a resource consent application to subdivide significant forestry land holdings.

Auckland Council

Conducting appeals before the Alcohol and Regulatory and Licensing Authority in relation to the Provisional Local Alcohol Policy, defending applications for judicial review of the Authority’s decision, and subsequent appeals to the Court of Appeal and Supreme Court.
