Tim Fischer

Tim is a senior associate in the firm's local government and environment group. Tim is experienced in all aspects of resource management law, including subdivision, land-use and property development, infrastructure projects, plan-making, and designations. He acts for local authorities, corporates, and developers.

Tim also has experience with public law matters and the wider legislative framework affecting the local government sector through the work he has done with local authorities. This work has traversed a wide range of legal matters, from information issues through to alcohol policy and regulation. He has often been involved in defending judicial review proceedings in the High Court.

  • Auckland Council - conducting appeals before the Alcohol Regulatory & Licensing Authority in relation to the Provisional Local Alcohol Policy, and defending applications for judicial review of the Authority’s decision
  • Christchurch City Council - conducting appeals before the Alcohol Regulatory & Licensing Authority in relation to the Provisional Local Alcohol Policy, and defending an application for judicial review of the Council's decision to reconsider its Provisional Local Alcohol Policy
  • Auckland Council - defending an application for judicial review of the Council's decisions to grant non-notified resource consents
  • Tauranga City Council - conducting High Court proceedings to defend the Environment Court’s decision on regionally significant infrastructure under the Proposed Bay of Plenty Regional Coastal Plan
  • Port Blakely - conducting Environment Court proceedings to determine the landscape status of Matakana Island in the Western Bay of Plenty, a proposed plan change affecting significant forestry holdings on Matakana Island and a resource consent application to subdivide significant forestry land holdings
  • Mountain Road Property Company - successfully obtaining resource consent for new consulting rooms associated with the Mercy Ascot hospital
  • Watercare Services - successfully obtaining consent for the new South-West Sub-Regional Wastewater treatment plant
  • Auckland Council - conducting Environment Court and High Court appeals against the Council's decisions on the Proposed Auckland Unitary Plan, including successfully defending appeals against the Council’s decision to maintain an outstanding natural feature and land containing elite soils outside the Rural Urban Boundary under the Auckland Unitary Plan
  • Auckland Council - conducting proceedings before the Independent Hearings Panel on the Proposed Auckland Unitary Plan including parts of the Regional Policy Statement, all business zones, financial contributions, site-specific height requests across the Auckland Region and rezoning and precinct work
  • Auckland Council - advising on and responding to all requests for information relating to the Proposed Auckland Unitary Plan under the Local Government Official Information and Meetings Act
