Kate Stubbing

Kate is a senior associate in the firm's local government and environment group. She has a wide range of experience in many aspects of resource management, environmental, and local government law.

Kate advises corporate clients as well as local authorities and a number of CCOs under the Auckland governance structure, including Auckland Transport, Watercare, and Panuku Development Auckland.

Kate has appeared before Independent Hearings Commissioners, the Environment Court, and the High Court on resource consent applications, plan and plan change appeals, enforcement and declaratory matters, and judicial review proceedings.

Kate joined the firm in 2011 after returning from overseas, where she spent three years working as a planning and environmental lawyer in the United Kingdom.

Examples of Work

  • Panuku Development Auckland - acting for the applicant through the fast tracked direct referral process to obtain the necessary resource consents for new infrastructure and for Auckland to host the America’s Cup 36 in 2021
  • Auckland Transport - currently advising on a number of the resource consent applications associated with the Downtown Infrastructure Development Programme that is seeking to transform the CBD waterfront by improving the seismic resilience of Quay Street, construction of new ferry terminals and public space within the ferry basin, and enhancements to Quay Street
  • Watercare Services - successfully obtaining comprehensive wastewater network discharge consents for Auckland region, resource consents for replacement wastewater outfall at Army Bay and advising on Watercare’s wastewater servicing project for Whangaparaoa and surrounding growth areas
  • Fletcher Residential – advising on the proposed residential development of the Three Kings Quarry (for up to 1500 houses) including Environment Court appeals to the Auckland Council plan change decision, and inclusion of precinct in the Unitary Plan
  • Auckland Transport – successfully obtaining resource consent for three separate stages of the Silverdale Park and Ride
  • Auckland Transport - successfully obtaining approval to alter the Britomart Train Station designation for works required beneath the station as part of the City Rail Link project
  • Auckland Transport - advising applicant for Phase 1 of Auckland Manukau Eastern Transport Initiative (AMETI) project, including preparation of notice of requirement and resource consent application documentation, Council hearing, and managing resolution of Environment Court appeals
  • Auckland Council – acting on a number of High Court judicial review proceedings in relation to Council decisions not to notify and grant resource consent, for example, to residential developments in Piha and Titirangi, and commercial development in Manukau (the Wendco Supreme Court proceedings)
  • Auckland Council – advising on a number of Environment Court appeals to plans and plan changes, and appearing at the Hearings Panel in relation to a number of proposed Auckland Unitary Plan central area precincts
  • Auckland Council Property - successfully resolving Environment Court appeal for ACPL as applicant for resource consents to operate and extend quarry on Waiheke Island
