Sam Hider is an expert commercial and insurance litigator who helps clients resolve commercial disputes, particularly complex corporate, contractual, negligence or Fair Trading Act claims.  He also provides risk mitigation advice.

Sam complements his skills in dispute resolution with a deep understanding of insurance law and policy interpretation.  Sam often acts for professionals who are faced with claims for professional liability claims and disciplinary complaints.  His practice otherwise covers the insurance spectrum, including public liability, property, construction, material damage, business interruption and health.

He is a highly effective and experienced courtroom advocate.  He brings clarity and insight to complex disputes and never loses sight of a client’s strategic goals.  He tailors his advice for his client’s needs, and suggests creative and efficient dispute resolution techniques.  

Sam has a long association with Community Law Canterbury and has previously been a member of its board.

Commercial litigation experience

Acted on a wide range of employment, contractual and tortious disputes, including appearing as junior counsel in the successful defence of an injunction application (Multimedia Communications Ltd v Enable Services Ltd [2021] NZHC 568) and application for leave to appeal an arbitral award (Multimedia Communications Ltd v Enable Services Limited [2022] NZHC 3452) and a key member of the team advising on an associated arbitral dispute.

Investigations and inquiries

Acting for a number of entities in the Royal Commission into Abuse in Care and assisting a King’s Counsel in his high profile investigation into a student’s death. 

Professional liability claims

Successfully resolved a number of litigated claims including claims against geotechnical engineers, structural engineers, project managers, building surveyors and architects.

Indemnity advice

Provides advice on policy response to insurers and insureds.

Commercial insurance

Advised on numerous large business interruption claims during the initial COVID-19 lockdowns in New Zealand and the Cook Islands.  Advised on a number of large, commercial claims in Wellington resulting from various earthquakes.

Residential earthquake claims

Successfully resolved hundreds of residential earthquake insurance claims against nearly all insurers operating in New Zealand resulting from the 2010/2011 Canterbury Earthquake Sequence.  Has appeared as lead counsel in mediation, the Greater Christchurch Claims Resolution Service and the Canterbury Earthquake Tribunal and as junior counsel in a number of High Court claims.
