James Craig

James is a partner in the commercial litigation group. He specialises in competition law and commercial litigation. 

James provides advice on all aspects of restrictive trade practices and acquisitions under the Commerce Act, together with Fair Trading Act issues. He has been involved in significant court litigation dealing with Commerce Act and Fair Trading Act claims, together with numerous clearance applications for acquisitions. He has also assisted clients with successful leniency applications to the Commission. He regularly provides compliance seminars to clients on the Commerce Act and the Fair Trading Act. 

James also acts for a range of clients in litigation involving general commercial matters, assisting with all aspects of litigation ranging from alternative dispute resolution through to court proceedings.

  • DLF - acting for DLF in 2018/2019 in relation to obtaining clearance from the Commerce Commission for DLF to acquire PGW Seeds
  • Thales / Gemalto - obtaining clearance from the Commerce Commission in 2018 for both parties in relation to their global merger
  • OMV - acting for OMV in 2018 in relation to the successful application for clearance to the Commerce Commission for OMV to acquire Shell’s remaining gas production interests in New Zealand in the Maui and Pohokura gas fields
  • Cerebos-Gregg's/Suntory - acting in 2017/18 for Cerebos-Gregg's in relation to the application for clearance to the Commerce Commission for Kraft Heinz to acquire their NZ Sauces business
  • LJ Hooker - acting in 2016/17 in the Commission's proceedings in the High Court against the major real estate companies under s30 of the Commerce Act
  • Nelson City Council and Tasman District Council - acting for both Councils in 2016/17 in relation to the authorisation application filed with the Commission regarding a joint landfill proposal
  • Revera - acting for Revera in 2015 in successfully defending a $3.7 million damages claim in High Court proceedings brought against it by Prophecy
  • Novartis - acted on the clearance application to the Commerce Commission in 2014 regarding the creation of a Consumer Healthcare joint venture with GlaxoSmithKline
  • Wotif - acted on the clearance application to the Commerce Commission in 2014 allowing Expedia to proceed with its A$700 million acquisition of Wotif
  • HireQuip - Commerce Commission clearance for sale to Hirepool in 2013
  • Mighty River Power - successfully opposed an appeal in the High Court against the Electricity Authority's decision that there was an "undesirable trading situation" under the Electricity Industry Participation Code as a result of "Superspike Saturday"
  • HP Industries (NZ) - Commerce Commission clearance for sale to Visy in 2012
  • Matariki Forests - Commerce Commission clearance for the acquisition of forestry assets of Selwyn Plantation Board in 2011
  • HIH and FAI - acting for the liquidators in various Court proceedings relating to these insurance companies, now in liquidation
  • Novartis - Commerce Commission clearance for the acquisition of Alcon in 2010
