Shanti Frater

Shanti is a partner in the firm's construction group. She is a specialist construction lawyer with over 15 years’ experience including six years with a top litigation firm in Canada before joining the firm in 2009. She is admitted as a barrister and solicitor in both Canada and New Zealand.

Shanti acts for clients in drafting the tender and contract documentation based on NZS3910/3916/3917, CCCS, FIDIC, NEC3 and bespoke forms of contract for construction projects of all sizes.

Shanti also specialises in the resolution of construction disputes through adjudication (under the Construction Contracts Act), mediation, arbitration, and other forms of alternative dispute resolution. Shanti has been involved in numerous complex adjudication claims ranging from claims for a few hundred thousand dollars to multi-million dollar claims.

  • Christchurch City Council - advising on recovery “Anchor Projects” following the Christchurch earthquake and new infrastructure and asset renewal projects since then including:
    • Town Hall regeneration
    • New Central Library
    • Three Waters Capital Works Programme - preparing framework panel agreements including RFQ and template contract documentation (consultancy services and physical works) for delivery of Council’s three waters capital programme over the next five years
    • Christchurch Northern Corridor including Northern Arterial Extension (through an alliance agreement with the New Zealand Transport Agency)
    • Wastewater Lyttelton project (stages 1 - 4)
    • Canterbury Multi-use Arena
    • Sumner Road geotechnical risk mitigation works and road re-opening
    • QEII Eastern Recreation Centre
    • Linwood Pool
  • Fletcher Construction - providing strategic legal advice to Fletcher on the New Zealand International Convention Centre and Horizon Hotel projects during the construction
  • Manukau Institute of Technology - advising MIT and Auckland Transport on the $90+ million Manukau Tertiary Campus and Transport Interchange project following insolvency of the original contractor and need to restructure the project and engage a new contractor for completion including preparation of the two-stage completion contract for the remainder of the works including integrated fitout
  • Waitemata District Health Board - developing template tender and contract documentation (based on NZS3910/3916 standards, CCCS and bespoke minor works contract) for use on all the health boards infrastructure projects, reviewing and advising on all asset renewal and new infrastructure projects at Waitakere hospital, North Shore hospital and the Mason Clinic
  • Tauranga City Council - Southern Pipeline - preparing design and construct contract for the first stage of the project involving Memorial Park Pump Station to Judea Link; assisting Council to resolve disputes over unforeseen ground conditions; preparing the contract documentation and providing procurement advice for the final stage of the project involving the Tauranga Harbour Crossing
  • Unitec Institute of Technology - preparing the procurement and construction contract documentation to support Unitec's transformation of the Mt Albert campus, including lead consultancy agreements, tender and construction documentation for the Hub and Construction Engineering and Trades (CET) buildings (construction completed) and tender and contract documents for procurement of FF&E for the Hub and CET buildings
  • University of Canterbury - advising the University on the development of a new 400+ bed Student Accommodation Facility in Christchurch including procurement advice, assisting with market engagement, preparation of the design and construct contract, and negotiating the contract with the preferred design and construct contractor
  • Bunnings - preparation of tender and contract documentation for Bunnings Warehouse stores across New Zealand including Hamilton (Te Rapa), Grey Lynn, New Lynn, Silverdale, Queenstown, and Wanganui
  • Adjudications under the Construction Contracts Act 2002 (as amended) acting for contractors and principals including on complex, high value adjudications for the following clients:
    • Watercare
